Policies
The Town of Silverthorne has several policies in place to foster an inclusive community while maintaining the privacy and safety of our residents, businesses and visitors. Please review the Town's social media, privacy, website accessibility and Americans with Disabilities Act policies below.
In accordance with the requirements of Title II of the Americans with Disabilities Act (ADA) and the latest WCAG 2.0 standards, the Town of Silverthorne will not discriminate on the basis of disability in the admission, access, or operations of its programs, services, website, activities or facilities.
Employment
The Town of Silverthorne does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the Americans with Disabilities Act (ADA).
Effective Communication
The Town of Silverthorne will generally, upon request, provide appropriate aids and services leading to effective communication for qualified personals with disabilities so they can participate equally in the Town’s programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.
Modifications to Procedures
The Town of Silverthorne will make reasonable modifications to programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services and activities. For example, individuals with service animals are welcome in Town of Silverthorne facilities.
The ADA does not require the Town of Silverthorne to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.
Paratransit Service and Transporting Service Animals
ADA paratransit service is available to qualifying individuals through the Summit Stage Mountain Mobility program. A Mountain Mobility application for paratransit services is located at: http://www.co.summit.co.us/375/ADA-Paratransit-Service. Service animals are welcome aboard per ADA regulations and must be kept under the control of their handler at all times and must not obstruct bus aisles nor interfere with the safe operation of the bus. Pets are permitted in a secure pet carrier.
ADA Coordinator
The Town of Silverthorne has established an ADA Coordinator to facilitate assistance for disabled residents and visitors. Anyone who requires an auxiliary aid or service for effective communication, or a modification of procedures to participate in a program, service, or activity of the Town of Silverthorne, should contact the ADA Coordinator by email or at 970-262-7379 as soon as possible but no later than 72 hours before the scheduled event.
The Town of Silverthorne will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of procedures, such as retrieving items from locations that are open to the pubic but are not accessible to persons who use wheelchairs.
Complaints that a program, service or activity of the Town of Silverthorne is not accessible to persons with disabilities should be directed to the ADA Coordinator by email or at 970-262-7379.

The Town will notify the poster that he/she has been blocked and will provide an opportunity for the poster to appeal the decision.
General Policies for the Use of Town of Silverthorne Property and Facilities
I. Purpose
A. The purpose of this policy is to establish general guidelines regarding the use of all Town of Silverthorne (the “Town”) property and facilities by non-Town organizations and individuals who are not otherwise engaged in official business on the premises. These generalized policies and procedures are intended to compliment and be consistent with the policies and procedures for all Town properties and facilities as provided in the Appendices. In the event that any policy for any specific Town property or facility is inconsistent or in conflict with these policies and procedures, the specific facility policy shall supersede and override any such conflicting existing policies and procedures, to the extent necessary. The Town reserves the right to amend the policies set forth herein.
B. These policies are intended to comply with all legal requirements of the laws, rules and regulations of the State of Colorado and the United States Government regarding the use of public facilities for speech, including but not limited to the First Amendment of the United States Constitution, Article II, Section 10 of the Colorado Constitution, and all other laws, rules and regulations of the State of Colorado and the United States Government regarding the rights of free speech, assembly, and association.
C. These policies and procedures are intended to provide reasonable protection and accommodation for the rights of the public in the use of Town property and facilities, and to allow for public speech and assembly at reasonable locations while preserving the ability of the Town to perform and protect the primary functions of such property and facilities. In promulgating these policies, the Town finds that it is a primary purpose to ensure that the public, as well as agents, employees and officers of the Town, are able to utilize and enjoy the primary functions of such buildings and facilities.
D. The Town shall apply these policies without regard to the Speaker’s viewpoint. Town officials shall apply these policies to restrict use of certain buildings and facilities, in a manner which may have the secondary effect of limiting certain broad categories of speech content, such as commercial or political speech, when narrowly tailored and reasonably necessary to maintain the nonpublic, limited, or designated nature of certain forums throughout the Town. Nonetheless, in the application of these policies, the Town shall make efforts to accommodate all Speakers subject to reasonable time, place, and manner restrictions.
II. General Policy.
A. Traditional Public Forums. The public shall have the right to speak and assemble at places traditionally open to the public for such purposes in a manner that does not unreasonably interfere with the rights of other members of the public and the Town to use such public facilities. By way of example, traditional public forums include parks and sidewalks.
B. Non-Public Forums.
i. Non-designated facilities. Any Town property or facility, or any portion of a Town property or facility not a Traditional Public Forum (i.e. parks and sidewalks) or a Designated Public Forum as provided herein, shall be considered a Non-public Forum, and will be open to the public only for the permitted and intended uses of such areas.
ii. Areas of ingress, egress, and circulation. Areas of any Town building or facility that are primarily utilized for means of ingress or egress to and from such building or facility, or otherwise utilized for the primary purpose of circulating throughout various offices or facilities of any building, and any waiting rooms for any Town offices or departments, are expressly designated as non- public forums, and no public use or activities outside of the specific primary function of such building or facility shall be allowed.
Designated Public Forums. There is designated by Appendix B of this Policy a Designated Public Forum pursuant to policies set forth therein. The Town has not designated any other facilities as such.
III. Permits for organized events.
A. Permit Required. Permits for organized events at Town facilities that are Designated and Traditional Public Forums are subject to the procedures in the Silverthorne Municipal Code Section 4-4-27 Event Permits.
i. Permits are required for organized events at Town parks when it is anticipated that more than twenty-five people will attend, or a tent, amplification, or other significant impact to the park experience is requested. Permit applications for such events shall be made not less than seventy-two (72) hours prior to the event.
ii. Permits are required for any organized parade, protest, or procession utilizing the Town right-of-way when it is anticipated that more than ten people will attend. Permit applications for such events shall be made not less than seventy-two (72) hours prior to the event.
B. Facility Priority. Permit applications shall be processed on a first-come first-served basis and depending on the availability and capacity of the requested facility. Town activities shall receive first priority for the use of the available facilities and may require an existing permittee to move or reschedule an event.
C. Regulation. Permits are subject to the Silverthorne Municipal Code and reasonable time, place, and manner restrictions that ensure the public safety and orderly keeping of Town business. Event attendees may not block traffic within the Town right-of-way, or access to any buildings or private property.
D. Denial. In addition to the standards provided in section 4-4-27 of the Silverthorne Municipal Code, permits may be denied for activities that include obscenity, actual threats of violence, and fighting words.
Appendix A
Policy governing the time, place and manner of first amendment activities in and around the Town of Silverthorne Recreation Center.
Section 1. Purpose
The purpose of this Policy is to govern and balance the legitimate interests of those engaged in speech and conduct protected by the First Amendment to the United States Constitution on premise of the Town of Silverthorne Recreation Center, 430 Rainbow Drive, Silverthorne, Colorado ("Recreation Center"), and the rights and privileges of patrons and employees of the Recreation Center.
Section 2. Governmental Interests
The Recreation and Culture Director hereby determines that the following governmental interests require the promulgation of this Policy:
A. Protection of unaccompanied minor children while present at the Recreation Center.
B. Protection of the rights and privileges of patrons of the Recreation Center to attend, register for and participate in programs and activities of the Recreation Center.
C. Protection of the right of Recreation Center employees to perform their assigned governmental tasks free from distraction and unwelcome harassment.
Section 3. Restrictions
A. No personal distribution of leaflets, pamphlets, books, magazines, literature, brochures or similar printed materials, or unsolicited speech of any sort or nature, may be conducted anywhere inside the Recreation Center.
B. Written materials may be placed only in the following areas of the Recreation Center: Front Lobby Area on kiosk ("Designated Areas").
C. Written materials placed in the Designated Areas may not display obscenity, actual threats of violence, or fighting words.
Appendix B
Policy governing the time, place and manner of first amendment activates in and around the Silverthorne Town Center.
Section 1. Purpose
The purpose of this Policy is to govern and balance the legitimate interests of those engaged in speech and conduct protected by the First Amendment to the United States Constitution on premise of the Silverthorne Town Center, 400 Blue River Parkway, Silverthorne, Colorado ("Town Center").
Section 2. Silverthorne Pavilion
Designated Public Forum. Subject to the Town’s permitting requirements, the Silverthorne Pavilion is hereby recognized by the Silverthorne Town Manager as a Designated Public Forum more suitable for public use of a broader array of activities. Accordingly, the Pavilion is designated as the primary facility for activities deemed generally inappropriate at other Town facilities carrying a primary administrative governmental purpose. The use of the Pavilion as a Designated Public Forum shall be primarily governed by the specific Pavilion Policies and Procedures.
Election Day. The Silverthorne Pavilion is commonly a polling location for municipal and coordinated elections. No Electioneering (i.e. campaigning for a candidate or ballot question that is on the ballot, or signature collection) may take place at or within 100 feet of the Pavilion on Election Day. In addition, the Town may designate specific locations on Election Day within the Town Center to permit the safe and orderly expression of political opinion, while facilitating the primary purpose of the Silverthorne Pavilion as a polling place.
Section 3. Silverthorne Performing Arts Center
Purpose. The purpose of the Silverthorne Performing Arts Center (PAC) is to facilitate the promotion of arts and culture.
Leased and interior spaces. The interior spaces and the back patio of the PAC are leased and managed by the Dillon Theater Company. As such these spaces are subject to the tenant’s rental policies and procedures, and public access as prescribed in its lease.
Outdoor spaces.
Public Forum. The lawn surrounding the PAC is a Traditional Public Forum subject to the Town’s permitting requirements for organized events, and other reasonable time, place, and manner restrictions.
