Since the passing of Summit County Referred Measure 1A during the 2019 Coordinated Election, a new Licensing and Taxation Program for the sale of Tobacco products took effect January 1, 2020.  

Silverthorne’s Article VII, Division 4 provides information on the purpose and applicability as well as the conditions for a tobacco license. If you are selling or distributing tobacco products, you are operating a Retail Tobacco Business.

"Tobacco Product" is any product containing, made of, or derived from tobacco or nicotine that is intended for human consumption or is likely to be consumed, whether inhaled, absorbed, or ingested by any other means, including but not limited to, a cigarette, a cigar, pipe, chewing tobacco, snuff, or snus; any electronic smoking device, and any substances that may be aerosolized or vaporized by such device, whether or not the substance contains nicotine; any component, part, or accessory of a device, whether or not these items contain tobacco or nicotine, including but not limited to filers, rolling papers, blunt or hemp wraps, hookahs, and pipes.

Each Retail Tobacco Business location must apply for a Retail Tobacco Business License and pay the licensing fee of $500.

Tobacco Products shall not be sold or transferred to any person under the minimum legal sales age of twenty-one (21) years of age.

No refund shall be made to any Licensee who discontinues business during the licensing year and no License shall be transferable.

All Retail Tobacco businesses must also obtain a Town of Silverthorne business license by January 31 of each year.

Licensing Application & Fee

  • Complete the Tobacco License Application here
  • Return filled out Application and Licensing fee payment ($500 annually) to:
    • Via mail to Silverthorne Town Clerk, PO Box 1309, Silverthorne, CO 80498
    • In person to Town Clerk located at Silverthorne Town Hall – 601 Center Circle
    • Make checks/money orders out to "Town of Silverthorne"

How to Remit Taxes

  • Your business must collect and remit the appropriate taxes to the Town of Silverthorne.  Details on how and when to remit sales taxes will be provided to you once you apply for your business license.
  • The County nicotine sales tax rate is $4.00/pack of cigarettes and 80% on all other tobacco and nicotine products including e-cigarettes and vaping devices for the remainder of 2024.
