Short-Term Rental Application

Please email us any changes to an existing short-term rental license (e.g. mailing address, responsible agents, property management company, contact information, etc.).

Short-Term Rental Licensing

A short-term rental property is defined as “a residential dwelling unit, or any room therein, available for lease for a term of less than thirty (30) consecutive days.”

A valid short-term rental license is required for each short-term rental property.
Deed-restricted properties are prohibited from being rented on a short-term basis.
Individual homeowner associations may have requirements, restrictions and covenants related to short-term rentals.
If the short-term rental property is part of a duplex, the owner of the adjoining unit is required to be provided written notice seven days prior to filing an application.
The license is required regardless of how the properties are marketed (through a management company, on-line through websites such as VRBO and Airbnb, newspaper ads, word of mouth, etc.).
The license number must be displayed in all advertising for the property.
Short-term rental licenses are non-transferable/non-refundable in event of property sale.

Short-Term Rental Cap

Town of Silverthorne short-term rentals are capped at 10% of the number of units in the majority of Town neighborhoods, Area 1, and 50% of the number of units within the Town Core and Riverfront areas, Area 2. Short-term rentals are not allowed within deed restricted neighborhoods, Area 3. View a map of Areas 1-3 here.

Taxes

The Town requires homeowners who short-term lease their Silverthorne residences to collect a 8.0% lodging tax. Click here for more information on Silverthorne taxes.

Occupancy

The maximum occupancy for a property is two people per bedroom plus two people. All reservations and advertising needs to comply with the maximum occupancy for the property. The number of bedrooms for a property is determined by the Summit County Assessor’s Office.

Good Neighbor Guidelines

The Good Neighbor Guidelines were created to educate Short-Term Rental (STR) owners and guests on the importance of being a good neighbor.

24-Hour Responsible Agent Contact Information: If at any time you have concerns about your stay or in regards to your neighbors, please call the 24-hour contact number listed in the rental lease agreement or posted in the property. In the event of an emergency, please call 911.

Fire Restrictions: Colorado has been in a period of extended drought and fire restrictions may be enacted by the Town depending on conditions. Even if fire restrictions are not in place, be fire-wise and only use approved outdoor devices and do not leave outdoor fires unattended.

General Respect for Neighbors: Be friendly, courteous and treat your neighbors like you want to be treated. Respect your neighbors and their property.

Noise and Outdoor Lighting: Be considerate of the neighborhood and your neighbors’ right to the quiet and peaceful enjoyment of their home and property, especially after 11 p.m.

Maintenance of Property: Be sure to pick up after yourself and keep the property clean, presentable and free of trash.

Waste Disposal: Place all trash and recycling in the designated containers stored indoors. The Responsible Agent will handle trash disposal on the designated pickup day by placing the containers at the appropriate place no earlier than 6:00 a.m. for pickup and returning trash and recycling containers to the designated indoor location by 7:00 p.m. on the day of pickup. Extinguish and dispose of cigarette butts properly.

Parking & Traffic Safety: Park in the designated parking spaces provided. Do not park on roadways, lawns, or in a manner which blocks driveways, sidewalks, alleys or mailboxes. Drive slowly through neighborhoods and watch for pedestrians and children playing. Parking on the street(s) in the Town of Silverthorne is prohibited and subject to fines.

Pets: Promptly clean-up after your pets. Prevent excessive and prolonged barking and keep pets from roaming the neighborhood. Control aggressive pets and be sure to abide by the local leash laws. Store pet food indoors and in a secure container to reduce the likelihood of unwanted pest problems.

Respect Wildlife: Do not feed or approach local wildlife.

Tenant/Guest Responsibility: Approved guests and visitors are expected to follow the Good Neighbor Guidelines. Be sure to read your rental agreement for additional terms and restrictions which may include consequences for violating the Good Neighbor Guidelines.

What is a Short-Term Rental (STR)?
A short-term rental is a residential dwelling unit, or any room therein that is rented for periods of less than 30 consecutive days.
Is my property within the Town limits of Silverthorne?
Visit the Summit County Assessor's website to determine your property's location. Unincorporated sections of Silverthorne will not fall under the Town of Silverthorne's ordinance, but under Summit County's regulations. Unincorporated sections are still responsible for remitting taxes to the state and county.
What do I need to do to apply for a STR License?
- Complete the Application for a Short-Term Rental License
- Complete and Notarize the Short-Term Rental Self-Compliance Affidavit
- Complete the Short-Term Rental Registered Agent & Owner Authorization Form
- Read and Sign the Good Neighbor Guidelines
- Submit all documents above to the Town along with payment for the STR License
What taxes do I need to collect on my rentals?
The total combined tax rate to collect on your short term rental sales is 16.375%
- Town of Silverthorne: 10% (2% sales tax and 8% lodging tax)
- State of Colorado: 2.9%
- Summit County: 2.0%
- Summit County Transit tax: 0.75%
- Summit Combined Housing Authority: 0.725%
Where do I submit my monthly or quarterly taxes?'
Town of Silverthorne Sales and Lodging Tax can be filed and paid online.

State Sales Tax & Summit County

The Colorado Department of Revenue collects state and county taxes. The Secretary of State issues trade names and can be reached at 855-428-3555 or visit them on the Colorado Secretary of State website.

Are the fees prorated if Short Term Rental is applied for later in the year?
No. The fees are fixed regardless of license application/issue date(s).
Is my Short Term Rental license transferrable when property transfers?
No. The new owner must complete an application for a Short Term Rental license. A Short Term Rental is uniquely tied to an individual property and owner.
What if my property is a duplex?
If your property is part of a duplex unit, you are required to provide a copy of the short-term rental application and a notice of intent to rent your unit to the adjoining property owner. A copy of the notice and proof of mailing will be required during the STR application process.
Do I need a Short Term Rental license if I hire a property management company?
Yes. The Short Term Rental license is to allow the property owner to operate in the lodging business. The property management company would possess a business license to provide property management services.
Why do I have to hire someone to manage my property?
A property owner is not required to hire an individual or company to serve as a responsible agent. The responsible agent needs to be available to respond to issues with the property.
Can I rent my property as an STR if I am in a homeowners' association?
If your property is subject to a homeowners' association or private covenant, you should verify that your residence is allowed to operate as a short-term rental. You should also determine if there are any restrictions or requirements that your association may require prior to applying for your STR license. During the application process, you will be asked to verify if you are subject to a homeowners' association or private covenant and to state if you do not need approval or have received approval to operate as a short-term rental.
Are there any requirements on advertising the property?
The current ordinance requires that you post your Town of Silverthorne Short-Term Rental Unit License Number on all advertising (print, online, etc.), and that it be located after the description of the property. Advertised occupancy cannot exceed 2 persons per bedroom plus two.
